Her lawyer, Earle Lilly, who will file legal papers in Miami, Monday, July 7, says the New York Yankees baseball star and Madonna have been having an affair "and are still together."
"Call it an affair, call it a relationship," Lilly told Us, "[she's put] up and tolerated his misconduct."
Madonna is not the only reason for the divorce; there have been other dalliances.
"Madonna was the last straw," says Lilly. However, she will not be named in the legal papers to be filed.
"You're not going to see a lot of other relationships named," says Lilly.
"The papers are designed not to be horrible, vitriolic, or create negative feelings, but just to put it out on the table and get this lady through a very troubled period in her life," Lilly adds.
Though A-Rod, 32, and Cynthia, 34, have a prenuptial, Lilly intends to focus on his infidelity and "emotional abandonment" to get a good settlement for Cynthia, which will allow her to retain primary custody of their two daughters: Natasha, 3, and Ella born on April 21.
Lilly says Rodriguez has seen his six week old daughter "once, maybe twice, but that's it."
A source told Us earlier that A-Rod "literally left 10 minutes after the baby was born, and then was at Madonna's."
A-Rod is estimated to be worth $1 billion.
Lilly told TMZ that there will be a "huge settlement" in the case but "not hundreds of millions of dollars."
