Funk was fired July 25 shortly after Britney's disastrous shoot with OK! Magazine.
It is believed that Funk was with Britney on the night of her 'spirited' topless romp in a hotel pool with video shoot extra she barely knew.
Funk claims Spears didn't ask her to sign a confidentiality agreement.
Kaplan had been trying to locate Funk for several days. According to TMZ sources, he called up Funk's mother's home several times over the past few days in order to contact Funk.
When they found her she was with the OK! senior reporter Shauna Bass and photo director Maria Collazo for what is believed was a tell all session.
It was reported earlier that Funk had been offered $500,000 to reveal intimate secrets and images of the singer.
